When you place an Order for a Product in any of the ways described above ("Order") you are offering to buy it for the price stated, subject to these Terms.

Our office is open 9am - 5pm, Monday to Friday. For details of opening details on Bank Holidays etc contact us.

We accept all major credit cards.

Invoice customers can pay by cheque made payable to "Chalkpens "

Contact us for Bacs details for making bank transfers and we will supply you with sort code and account number.

Prepayment can be made against Proforma invoices via cheque. Once the cheque clears the good will be despatched.


If you place an order over the phone, all order details will be read back to the customer for confirmation, once accepted by the customer any errors (outwith typing mistakes etc) will be the responsibility of the customer and we will not be liable for any additional costs / penalties arising from these errors.

Prices quoted on the website are exclusive of VAT (15%) which is added once you proceed to the checkout.

Your details will not be passed to any 3rd parties at any time. We may from time to time contact you to inform you of special offers, if you wish to be removed from our marketing lists please call us or email marketing@chalkpens.com

Prices quoted are in Pound Sterling or in any other currency on request. All payments are to be made in Pounds sterling. Payments in Euros or American Dollars on request.

We reserve the right to cancel any order without notice but will inform you if we do so and if payment has been received, a full refund shall be issued.

We always try to make sure that the prices on www.chalkpens.com are accurate but errors may occur. If we discover an error in pricing of the Products in your Order we will inform you as soon as possible using the contact details you supply us with. We will then give you the option of reconfirming your Order at the correct price or cancelling it. (If we are unable to reach you we will treat the Order as cancelled). If an Order is cancelled, any payment made for the Products will be refunded in full.

Non-EU customers are responsible for Import Duty/Tax in their respective countries. Unfortunately we cannot advise you what these costs will be - please consult your local customs office for more information.

We try to keep www.chalkpens.com as up to date as possible but cannot guarantee that particular Product will always be available. If we can't supply a Product you will not be charged for it and we will refund or re-credit your account with the amount debited by us.

All offers are available while stocks last. If we are unable to supply a Product you have Ordered, we will notify you as soon as we can after receiving your Order. If this happens, you may cancel your Order and we will refund you the money you have paid for it.

Shipping And Handling We aim to despatch all stock items within 48 hours of receipt of the order, to confirm contact us.

We despatch using Royal Mail and Parcel Force. For Signed For Services please note that you may be signing for the good being received "in good condition". In the rare occurance that goods arrive damaged, if they are signed for as "in good condition" we are not able to make any claim with the carrier therefore we will not refund the cost of the goods or offer a replacement. It is imperative that the goods are check before signing them "in good contition". if another individual signs for the goods it is your responsiblity to check they are aware of the delivery terms and conditions, you cannot claim if they have not been made aware of these conditions.

We delivery to mainland UK, if you are outwith this region please contact us to confirm delivery timescale and cost.

We endevour to inform you if there is a problem with your order however we will not be liable any losses, costs, damages, charges, or expenses caused by any delay of your order or if we need to cancel your order due to other factors.

If the Products are not delivered within the estimated delivery time which we quote, please contact us by telephone or email and we will try and ensure that you receive your Order, as quickly as possible, or if you wish you may cancel your Order and we will refund the money you have paid. Please note that while items sent by Royal Mail usually arrive within 1-3 days, Royal Mail stipulate that only items still not delivered after 15 working days can be officially classified as lost. We use Parcel Force for item of a larger weight (normally in excess of 1.5KG), this is a 24 hour service however they have the same policy that an item is not deemed lost untill 15 working days have lapsed from when it was sent.

Back Orders If your item is not in stock, we will back order for you. You will always be emailed with the option to cancel your order if you would rather not wait.
Tax Charges For orders made from the UK or the European Union, 20.0% VAT is added. All other orders are VAT free.

Your rights to return goods are protected under the EU Distance Selling Directive.

All stock items come with a 7 day return policy if you are at all dissatisfied (subject to being unused and returned in original packaging). Please note we cannot refund postage & packaging charges in this situation.

Contact us by email or telephone and quoting the order number supplied to you. Your refund will be paid within 30 days.

Any breakages must be reported within 24 hours of receipt of goods.

We cannot be held responsible for any further delivery or customs charges incurred once the goods have left our premises.

Severability
If any part of these terms and conditions is found to be unenforceable as a matter of law, the enforceability of any other part of these terms and conditions will not be affected.

Governing Law
These terms and conditions and any contract between us shall be governed by and interpreted in accordance with English Law and the English Courts shall have jurisdiction over any disputes between us.

Statutory Rights
These terms and conditions are in addition to your statutory rights as a consumer which remain unaffected.

We try to select and package the Products as well as possible to ensure they arrive in good condition. However, if a Product arrives damaged or with defects, or is not what you Ordered, we will replace it free of charge or provide a full refund as appropriate, if you return the Product to us at the postal address below within 7 days of receipt.
In these circumstances we will also pay you the cost of the return postage. Please obtain a proof of posting certificate with postal insurance from your Post Office to enable us to process the refund for your return postage costs. You will be responsible for the returned Products until they reach us.

Any goods returned should be in saleable condition.

These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply in the future.

None of these terms affect your legal rights and these are not diminished in any way. If any term is held to be invalid under any applicable statute or rule of law, that term is automatically omitted from the terms to minimum extent necessary to comply with the law and without affecting the validity or enforceability of the remainder.
